This document is a binding integral part of the contract for our customers as well as for the RapidShare AG. RapidShare AG is bound to keep this integral part of the contract legally effective regarding all upload and download activities of all customers. Exceptions are applicable only if explicitly mentioned in this document.
With every upload the following data is stored in addition to the actual file:
If we are legally obliged to turn over information about the origin of a file, we will fulfill that obligation. The legal circumstancees will be evaluated individually in each case. Without a legal basis, no information will be given to third parties.
Data privacy is an important integral part of the contract. That is why it is important for us to let you know what may and may not happen to your files.
Nobody can access your files without knowledge of the complete download link. This does also apply to RapidShare employees. There is no software that will scan your files for certain patterns or the like. However, there is a program which calculates the MD5 checksum for each file immediately after the upload. The MD5 checksum is a 16 bytes value which is always the same when calculated for the same file. This value is stored in connection with the file. If you upload and distribute an illegal file, we will delete the file upon notification and add the MD5 checksum to a blacklist, so the same file cannot be uploaded again.
# As you see, you can safely store even your accounting information on our servers. As long as you don't pass on the download link, your files will neither be downloaded nor viewed by anyone.
By default you can just view how many times a download of your file has been started. That number does however not indicate how many downloads have actually been completed. In case of technical problems, some download programs will restart the download over and over again, therefore, in some cases the number will be significantly higher than the actual number of downloads. Thus that number can only serve as an estimate.
When using TrafficShare downloads you can enable the creation of log files for a selected file ("Logged TrafficShare"). Thereby, the following additional information will be stored in connection with the file ID: start time and end time of the download process, file size, the starting position of the download within the file, downloaded volume of data, and, if applicable, information about download accelerators.
In addition you can optionally include one custom parameter (e.g. the customer ID from your system) in your download link, which will also be stored. By this means you will be able to analyse which countries your customers live in, or to verify if a certain customer has successfuly completed the download of a file. Be aware that the customer can see (and also remove) the information, as it is included in the download link. In order to prevent the customer from removing the information, you can use secured logged TrafficShare files. In this case the customer will not be able to download the file if the download link is modified.
Please note: This feature is only available for customers in possession of a verified account with RapidPro. As the logs are causing high additional server load, we are charging higher TrafficShare fees than for downloads without the logging feature. Due to the huge server load only a few files in the whole RapidShare system will be able to generate download logs at the same time, so it is possible that at certain times you will not be able to activate the logging until the logging feature has been deactivated for other files. It's understood that you can proceed with providing just the usual TrafficShare files.
No, this information will not be stored in the download logs. Since you administrate your own customers database, this will not be necessary. If your customer wants to purchase a DVD from your online shop, you can just generate an individual download link that contains all the information in its custom parameter. Thus, the download log will show you if that customer was able to complete the download process.
In order to activate the logging feature for a certain file, choose the option "Logged Traffic Share" in your file management tool.

No. As the log-option is causing a higher server load and consequently higher costs, it is only available for downloads whose traffic is paid for by the provider of the file. Furthermore the customer needs to be in possession of a verified account with RapidPro.
You can engage this option at any time, but the additional information will only be logged from that time on. Information about past downloads cannot be reconstructed.
In this case the files will automatically be treated like normal files and no more logs will be provided. In addition, the customer will see the RapidShare website when trying to download and will have to wait a little before being able to download the file (if not using an account with RapidPro). However, if you used to offer secured TrafficShare files, the security mechanisms are still always intact.

No. RapidShare does not store this information. Accordingly, we could not pass on this information, even if we wanted to. The prohibition of such logs is an inherent part of the contract for all our customers and we don't handle this differently for those who use the Free hosting either.
If you are using an account with RapidPro, the amount of data, the date of your download and the beginning of your IP-address will be stored linked to your account-ID.
You can review this data within your personal area My RapidShare and therefore check whether your account has been used by someone else without your consent. This data will be used for traffic calculation and, as the case may be, provide hints for impermissible account-sharing and will be deleted after 90 days.
If you are not using an account with RapidPro, the amount of data will be stored temporarily, linked to your IP address. This data will only be used to calculate the traffic for users with a free account and will be deleted after about two hours. In no case will we store information about which data has been downloaded by which IP address or account with RapidPro.
If you are downloading a file of a customer who engaged TrafficShare-Logs, the following data will be stored linked to the file-ID: Start- and end time of the download activity, size of file, starting position of the download within the file, downloaded amount of data, and, if applicable, information sent by a download accelerator.
In addition, the provider of the file is able to include further information in a special 64-byte-sized database column which will be added to your download link (e.g. your customer ID in their system). This additional information is openly recognisable in your download link. Please ask your content provider which data is added if neccessary. We do not store anything but the information mentioned here.
Even if we wanted to do so (meaning we would risk to be prosecuted by millions of customers), we couldn't implement that technically. Per day there would occur several billions of log entries. It's technically impossible to gather this amount of data without investing a sum in the hundreds of millions of Euros.
Furthermore, the storage of download logs is prohibited in many countries. If anyone should legally try to force us to monitor customers to such an extent, we would gladly go through all levels of jurisdiction in order to avoid that.
RapidShare is supposed to be a top-quality alternative for every content provider who doesn't want to care about own servers. To many providers it is essential to keep a certain amount of control about information such as the locations their files are being downloaded from, whether or not downloads were completed and where occurring problems originate from (e.g. when using downloading tools). Just imagine you are buying a movie and your download stops after you got 90%, but your download link is already void because you didn't realise the mistake before the next day. How do you prove that to the content provider? With those optional logs we prevent trouble and strained nerves on the part of content providers as well as customers. We are convinced that our current solution provides excellent service to the providers of digital content and that it eliminates abuse by illicit data miners.

Secondly, a short survey amongst our employees proved that nobody is happy about unordered offers of fake watches or blue pills and most of us would welcome if all spammers would get banned to a desert island - without any access to the internet.
